Welcome to Apex Web Server. By accessing or using our hosting services, VPS services, reseller hosting, domain services, or any products provided by our platform, you agree to comply with the following Terms & Conditions.

Any website found hosting illegal content, phishing pages, malware, spam, fraudulent activities, or abuse will be automatically suspended or terminated without prior notice and without refund.

1. Acceptance of Terms

By purchasing or using any service from Apex Web Server, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you disagree with any part of these terms, you must immediately discontinue using our services.

2. Services Provided

Apex Web Server provides various hosting and web-related services including but not limited to:

  • Shared Hosting
  • Reseller Hosting
  • VPS Hosting
  • Cloud Hosting
  • Dedicated Servers
  • Domain Registration
  • Email Hosting
  • Web Design & Development

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. User Responsibilities

Customers are responsible for maintaining the security and confidentiality of their account credentials. Users must ensure that all hosted content complies with local and international laws.

  • Maintain account security
  • Use services legally
  • Provide accurate billing information
  • Keep backups of important data
  • Avoid misuse of server resources

4. Prohibited Activities

The following activities are strictly prohibited on Apex Web Server infrastructure:

  • Hosting phishing or scam websites
  • Malware distribution or malicious scripts
  • Spam emails or bulk unsolicited mailing
  • Copyright infringement or pirated content
  • Illegal adult or explicit content
  • Cryptocurrency scams or fake investment platforms
  • Carding, cracking, hacking-related content
  • DDoS attacks or network abuse
  • Hosting leaked databases or stolen data
  • Botnets or abusive automation
  • Illegal gambling or fraudulent services
  • Activities violating Indian or international laws

5. Auto Suspension & Abuse Policy

Apex Web Server uses automated monitoring systems and manual reviews to detect abuse, malware, phishing pages, spam campaigns, suspicious traffic, and illegal activities.

If abuse or suspicious activity is detected, we reserve the right to:

  • Automatically suspend the hosting account
  • Disable website access immediately
  • Remove harmful or illegal files
  • Terminate services permanently
  • Blacklist IP addresses
  • Report severe violations to legal authorities if required

Suspended or terminated accounts due to abuse, illegal content, spam, phishing, fraud, or Terms violations are NOT eligible for refunds.

6. No Refund Policy

Refunds will NOT be issued in the following situations:

  • Violation of Terms & Conditions
  • Hosting illegal or abusive content
  • Spam or phishing complaints
  • Fraudulent activity
  • Chargeback disputes
  • Resource abuse or server misuse
  • Termination due to security threats

7. Resource Usage Policy

Shared hosting accounts must not excessively consume CPU, RAM, disk I/O, bandwidth, or database resources.

Accounts negatively affecting server stability or performance may be suspended, restricted, or terminated without prior warning.

8. Billing & Payments

  • All services are billed in advance.
  • Invoices must be paid before due dates.
  • Late payments may result in automatic suspension.
  • Failure to pay may lead to permanent account termination.
  • Chargebacks may result in permanent service ban.

9. Backups & Data Responsibility

Customers are solely responsible for maintaining backups of their data. Although periodic backups may be performed, Apex Web Server does not guarantee backup availability.

We are not responsible for:

  • Data loss
  • File corruption
  • Hacking incidents
  • Accidental deletion
  • Server failures
  • Service interruptions

10. Service Availability

We strive to maintain high uptime and reliable services. However, uninterrupted service is not guaranteed.

Downtime may occur due to:

  • Hardware failures
  • DDoS attacks
  • Maintenance activities
  • Network outages
  • Third-party provider failures
  • Unexpected technical issues

11. Limitation of Liability

Apex Web Server shall not be held liable for:

  • Business interruption
  • Revenue loss
  • Loss of profits
  • Indirect or consequential damages
  • Downtime-related losses
  • Security breaches caused by customer negligence

12. Account Termination

We reserve the right to suspend or terminate any service without notice if:

  • Terms & Conditions are violated
  • Abuse complaints are received
  • Fraudulent activity is detected
  • Security risks are identified
  • Payments remain unpaid

Upon termination, all hosted data may be permanently removed from our servers.

13. Changes to Terms

We reserve the right to modify or update these Terms & Conditions at any time without prior notice. Continued use of our services after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms & Conditions shall be governed in accordance with the laws applicable in India. Any disputes shall fall under the jurisdiction of courts located in Rajasthan, India.
